Terms and conditions Toolani
This document sets out the terms on which Toolani GmbH (”Toolani”, “we”, “us”) will provide Toolani Service (collectively the “Service”) to you, the customer (”you”).
By using the Service you agree to be bound by the following terms and conditions and acknowledge that we provide the Services to you on these terms. By using our service or accessing the website www.toolani.com you agree to be bound by these terms. If you don’t agree with this you may not use or activate the Toolani Service.
General
You can use Toolani by dialling the applicable access number. Your landline or mobile provider may charge additional charges for usage of their network. For details contact your landline or mobile provider. The Service is subject to availability. All relevant costs in relation to your use of Access Numbers are disclosed and can be accessed at www.toolani.com. Toolani routes calls via an access number. The cost of calling this number will be charged by your mobile operator. Callers must ensure they have the bill payer’s permission before using the Toolani services. By using the Services, you confirm that you have obtained such permission. The prices for Toolani services are posted on the Toolani website and are subject to change. Toolani reserves the right to terminate services where it suspects fraudulent or unlawful usage.
User Obligations
You shall not use, nor allow any other(s) to use, the Services on any landline or mobile that you do not have permission to use or make use of; fraudulently or illegally; in such a way that may damage, interrupt, destroy, corrupt, limit or affect the operation, functionality or quality of the Services, the network or any telecommunications system used to provide the Services or contrary to any relevant standard or code.
Liability and Warranty
Toolani disclaims to the fullest extent permitted by law all responsibility for any harm or loss resulting from use of the Toolani Services, Associated Services or other relevant Know How.
The Toolani Services are provided “as is” and “as available” for your use, without warranties of any kind. To the fullest extent permitted by law Toolani excludes all warranties of merchantability, fitness for a particular purpose, non-infringement of proprietary rights, security, reliability, timeliness and performance.
We do not make any representations or warranties in respect of your ability to access or use the Services at times or locations of your choosing (including any network or software operating in connection with the Services). We will, however, use reasonable skill and care to provide and maintain the availability of the Services.
Use of personal information
We respect your personal information and undertake to comply with applicable Data Protection legislation in place from time to time. By registering and entering your details on the Toolani website you consent to Toolani sending you information from time to time about relevant products and/or services.
Cancellation or Termination
You have the right to cancel any Account opened with us to use our Service at any time.If a Customer terminates the Service with a balance remaining in Credit, we will refund the balance to the credit or debit card used to purchase that Credit upon request. We require an administration fee to process this Account closure transaction that will be deducted from the balance of your Account. The administration fee is currently € 2,- but is subject to change.
Law
These terms and conditions are governed by the laws of Austria.
